For clarity of these terms and conditions, “Balikbayan Delivery, “Our” or “We” shall mean Balikbayan Deliveries, while “Customer” or “You” refers to any customer who uses the website or mobile applications to purchase products to be delivered.
Our delivery area services are limited to all barangays in Metro Manila (Caloocan, Las Piñas, Makati, Malabon, Mandaluyong, Manila, Marikina, Muntinlupa, Navotas, Parañaque, Pasay, Pasig, Pateros, Quezon City, San Juan, Taguig, Valenzuela). And in limited areas or locations in Cavite, Laguna, Bulacan, Bukidnon, Cebu, Davao, Lanao del Norte, Leyte, South Cotabato, Rizal, and Pampanga.
Placing an order to Balikbayan Delivery requires registration and creation of an account in our website or mobile application. If you decide to place an order you will be asked to provide your personal information which includes your name, complete delivery address, telephone or mobile number, email address and a password. This process means automatically filling-up all the necessary delivery details in your order.
Hence your unique password should never be shared with anyone. You agree to keep it secret at all times and you are solely responsible for keeping your password safe. You must not disclose it to anyone. Changing your password when you think it has been compromised is essential to maintain the integrity of your account.
Balikbayan Delivery also reserves the right to suspend your registration if we believe that any part of these Terms and Conditions has been breached.
If in case any other person used your account to order Products on your behalf, with or without your knowledge, such order is subject to these Terms and Conditions. All Orders placed under your Balikbayan Deliveries account are your sole responsibility.
Processing of Order
Upon submission of your online order, you are authorizing Balikbayan Delivery to proceed with your order. We however reserve the right not to process the order if details were not provided properly or in case of detected spurious transactions from the personal information.
As your order can be tracked through our online tracking system, non-response of the recipients to our staff’s call or SMS may result in late or non-delivery of the Products. This should not be taken against Balikbayan Delivery as an additional verification call to the recipient may be required to confirm delivery of the order.
Order Acceptance and Confirmation
Placing an order through this Site or App, you agree that the processing and delivery of your order is subject to the following terms and conditions:
- The minimum food purchase for a delivery transaction is $40.00 excluding Tax and Pasabuy fee (Delivery fee and Convenience fee).
- Orders are made in advance. Minimum of 3 days before the exact delivery date for a single transaction.
- Acceptance of an order transpires when the site tracker shows that the order is “confirmed” and an email has been sent confirming that order has been placed (Order is Confirmed”). This order must contain the order number, date and time of order, the grand total amount payable and the recipient’s details.
- Our staff will coordinate with the recipient through SMS, call, or email in relation to the details of the delivery.
- Any delay in the delivery caused by unexpected traffic, extreme weather conditions, natural disasters, technical difficulties or uncontrolled circumstances should not at any time be taken against us.
- Special requests beyond the list in the site menu are prohibited.
Cancellations or Refund
In cases of cancellation and request for refund, the same request must be made before confirmation of order made. The same must be made by sending an email to: firstname.lastname@example.org.
Cancellation request should include the following details:
- Order ID
- Order details
- Your full name
Cancellation after confirmation of the order will be subject to charging of the Convenience fee of $4.99.
Product, Prices & Payment Mode
The Products in the Menu Listing in every Store have ingredients that may contain Allergens. Balikbayan Deliveries is not obligated to provide information related to the allergen information on the Site or Mobile App. We do not guarantee that the Goods sold by Vendors are free of allergens.
The prices of products on Balikbayan Deliveries Site and mobile App are exclusive of service charges, applicable taxes and delivery charge. The prices of all products on this Site are subject to change without prior notice.
The payment of all orders made on our site can only be paid through cashless mode through credit card. Cashless payment on-site means redirection to a third-party payment gateway. You must acknowledge that Balikbayan Delivery is not responsible for any information provided in the 3rd party payment gateway.
You agree that the recipients will accept delivery of the Products on the time chosen and in the location provided on the online order form. Delivery with reasonable efforts will be done according to the confirmed date and time. However you understand and accept, that delay due to traffic, extreme weather conditions or conditions beyond our control should not at any time be taken against us.
You understand and agree that every product/s found to be available on Balikbayan delivery’s site are subject to availability at the time the order has been placed. However if for whatever reason some of the Products ordered are not available a day before the delivery, we will be contacting the recipient and offer a reasonable substitute Product of equal price and quality.
Limitation of Liability
Balikbayan Deliveries shall not be liable for any loss or damage arising out directly or indirectly in connection with the delay at any given time beyond our control even with the exercise of reasonable care. In any event, our liability for any given transaction shall not exceed the total amount paid for the ordered Products.
Also, the products delivered must be consumed within one (1) hour from actual receipt. Balikbayan Deliveries shall not be liable for any event that may arise as a consequence of consumption of the Products beyond the above stated time.
